The European Court of Human Rights officially announced that on January 25 it will issue a decision in a major case about the occupation of Donbas.
This was reported by the press service of the European Court of Human Rights.
“The European Court of Human Rights will rule on admissibility in the case “Ukraine and the Netherlands v. Russia” (applications Nos. 8019/16, 43800/14 and 28525/20) at an open hearing on Wednesday, January 25, 2023, at 2:30 p.m. in the House of human rights in Strasbourg,” the message reads.
The European Court of Human Rights explained that the case concerns the conflict in eastern Ukraine involving pro-Russian separatists, which began in 2014, and, in particular, the alleged constant practice (“administrative practice”) of violations of the Convention by the separatists of the “Donetsk People’s Republic” (“DPR “) and the “Luhansk People’s Republic” (“LPR”), as well as the downing of flight MH17 in eastern Ukraine on July 17, 2014.
The applicants in this case are Ukraine and the Netherlands. The Russian Federation is the respondent state.
The court’s recognition of the admissibility of the case will mean that the court recognizes Russia’s control over Donbas and determines the temporal and territorial limits of the occupation. This decision of the European Court of Human Rights will become an argument for other court processes.
