The Russian Federation never began to cooperate with the Independent International Commission to Investigate Violations in Ukraine.
This was stated by the head of the commission, Eric Möse, at a press conference in Geneva on March 16. during the presentation of the full report of the work of this UN international commission during 2022.
“While the Commission was able to establish a dialogue with the Ukrainian authorities and get answers to its questions, the Commission regrets that it was not able to establish such a dialogue with the Russian Federation,” said Miose.
For his part, the member of the Commission, Pablo de Graef, also pointed out that the Commission did not feel any actions in the direction of cooperation from the Russian Federation, which “did not make its work easier.” “We did not receive any cooperation from the Russian Federation. Of course, we tried to establish a meaningful dialogue with them, as we established it with the Ukrainian authorities,” he noted.
According to de Graef, the lack of cooperation with Russia, in particular, affected the completeness of the investigation, for example, the issue of the removal of persons detained in Ukraine and Ukrainian children to the territory of the Russian Federation. “All these things would have been much easier to find out if we had had full cooperation with the Russian authorities, but we didn’t get that,” noted Pablo de Greif.
The independent international commission to investigate violations in Ukraine established that the Russian authorities committed numerous violations of international humanitarian law and international human rights law in Ukraine, as well as “a wide range of war crimes.”
In addition, the Commission concluded that Russian attacks on the energy infrastructure of Ukraine, as well as the use of torture by the Russian authorities, “may constitute crimes against humanity.”
On March 4, 2022, the UN Human Rights Council adopted resolution 49/1 on the “situation in the field of human rights in Ukraine as a result of Russian aggression.” In accordance with this resolution, an independent international commission to investigate Russian war crimes in Ukraine was established.
During the presentation of the interim report in October 2022, it was reported that Russia was refusing to cooperate with the Commission.
